What they are doing is so transparent to anyone who bothers to look - and they are not the only agency that operates that way. Big money is what controls our lives, and the agencies we think are supposed to protect us instead serve to protect the profits of big pharma and big industry.
In a supreme court case that went against the FDA, one of the FDA's contentions was that allowing advertisements including testimonials for dietary supplements would tend to condition and brainwash the consumer into believing unproven medical benefits. That is so laughable considering how we and our doctors are literally bombarded daily with "Ask Your Doctor'" messages about drugs with known serious side effect, including death. Ah, but those are real drugs with proven effectiveness and safety - just look at their self reported and funded studies. And we know how thorough the FDA is in making sure the tests and medicines are safe.
The courts have also noted that the FDA has the provision to allow claims of health benefits provided a disclaimer is used. However, it was noted that the only time such disclaimer was approved for medical conditions was for food items - which just happened to be made by big corporations. Dietary supplements, depite being considered foods, are never granted the same permission.
No doubt the State is going to contend that all they are asking is to remove false medical claims (using the FDA's definition) and to have the facility inspected to insure the safety of the citizens. Sounds reasonable, at least the inspection part. But once you agree, it gives them the right to inspect at any time and to order the facility closed for any contrived violation. It would be all too easy and, imho, all too likely.
