suing ur ex is not going to "kill" the virus. Remember that now you can also infect other people and even if they know of the risks before sleeping with you, they may go cookoo on your and sue as well.... So, just get on with your life and figure out a way to reduce the frequency of outbreaks.
I've read that forgiving the person who infected you is one of the first steps to heal yourself and keep the virus dormant for longer periods fo time ;-)
